Democrats are pouring millions of dollars into Pennsylvania’s Supreme Court races this week to preserve their 5-2 majority as voters decide Nov. 4 whether to keep three liberal justices on the bench.
Spending in the race is expected to top $15 million — far surpassing previous retention races, according to the Associated Press. In the final week before the election, Democrats released a television ad featuring Gov. Josh Shapiro and brought in the national party chairman, Democrat Ken Martin, to campaign for the justices, the outlet reported. The ads promote the justices’ support of abortion “rights,” voting rights, and union rights.
Justices Christine Donohue, Kevin Dougherty, and David Wecht, all Democrats, are each seeking new 10-year terms. If all three are defeated, the court would likely fall into a 2-2 partisan deadlock, AP News reported, until Pennsylvania’s divided government agrees on temporary replacements.
Pro-life groups have urged voters to reject the justices. National Right to Life warned voters that retaining them would cement a court likely to allow abortion “for any reason during all nine months of pregnancy in Pennsylvania.”
The organization also criticized the Democrats’ campaign ads for “gleefully” supporting abortion, “even though one would expect judges to be fair and impartial.”
President Donald Trump also weighed in Nov. 2, urging Pennsylvanians on social media to vote against the “three Radical Democrat Supreme Court Justices.” He accused them, among other things, of “unlawfully gerrmander[ing] your Congressional maps.”
According to AP News, if any of the justices lose retention, Shapiro and the Republican-controlled Senate would need to agree on interim replacements until the 2027 election.
